Thank you for using this product! We are committed to providing you with a good test preparation service and experience. These Terms of Service (hereinafter referred to as "Terms") govern your use of AI Test Prep's (hereinafter referred to as "we", "our", "products" or "services") services, including any website, mobile application operated by AI Test Prep or its subsidiaries and affiliates.
Once you continue to use our services, you will be deemed to have read and agreed to any part and content of these Terms, and expressly agree to be bound by these Terms, acknowledge and agree to collect, use and disclose your information in accordance with AI Test Prep's Privacy Policy. If you disagree with any part of these Terms, you should stop using our services immediately.
You are ultimately responsible for the use of the Product. When using AI Test Prep's products, you do not need to create an account directly to access them, but we will tie you to your visitor status based on the apple id or google play id you are logged into. You may use the Products only if you fully agree to any part of this agreement and have a binding agreement with AI Test Prep.
If you, in your sole discretion, authorize another person (including a minor) to use your account, you are solely responsible for any access and use of the Product by that user.
2.1 Fees. You may download and use our Services for free, and the free version includes limited features and content. If you want to use the full range of features and content, you will need to purchase a subscription to upgrade to a paid version. We offer weekly, monthly, and quarterly subscriptions and one-time payments, so you can choose your subscription term flexibly according to your needs. If you choose to subscribe to the Service on a weekly, monthly or quarterly basis, you will be automatically renewed for your term and subscription price upon expiration of each subscription, unless you cancel your subscription earlier in your sole discretion. Subscription fees will be automatically deducted from your iTunes account or google play account. If you wish to cancel your subscription, please cancel your subscription at least 24 hours prior to the renewal expiration date. After you purchase a subscription, your free trial period will be automatically withdrawn (if applicable). You can also manage your subscription and cancel or turn off auto-renewal after purchase through your Account Settings. In addition, you may cancel your subscription by contacting us via email. If your account is suspended due to a breach of any of the terms of this Agreement, the term of your subscription and any fees paid will not be refunded without notice.
2.2 Third Party Fees; Additional Features. Any third party costs or fees charged, or increases in third party costs (such as an increase in the cost of postage for us to send you postcards) will be your sole responsibility. In addition, we reserve the right to charge you additional fees for adding additional features or module optimization. Also, you may accept or reject any such new features in your sole discretion, and we will only add such new features for you if we have your express permission or you expressly agree to them.
2.3 Taxes and Fees. Fees paid by You do not include taxes. You shall be solely responsible for all sales, use, value-added and similar taxes arising out of or in connection with the Services provided under this Agreement.
Subject to Section 1 of these Terms of Use, your free account registration is effective from the time of successful registration, and your free account is valid for an unlimited period of time unless otherwise specified.
Paid subscription contracts are valid for at least the initially selected term, and if you do not cancel your subscription at least 24 hours before the end of the term, you will be deemed to have agreed to the automatic renewal of the subscription. The new subscription term and price will be automatically extended based on the previously used subscription model. Canceled paid subscriptions will become effective on the day following the last day of the subscription term. Thereafter, you will still have free access to the free content and features of this product.
We reserve the right to change any Product in any form without prior notice, which may include making any Product or any feature of any Product available to you or users in general; or setting limits on the use of any Product. We may terminate or suspend your access to any Product, permanently or temporarily, without notice or liability, for any reason, including if we determine, in our sole discretion, that you have violated any provision of these Terms, or terminate or suspend your access to any Product for any reason. You remain bound by these Terms regardless of the reason or cause for termination without cause.
During the use of our services, it is prohibited to perform or promote any form of behavior that contributes to or is suitable for impairing the functionality and/or integrity of the application, in particular by interrupting, overloading or altering the application, as well as by performing acts of reverse engineering or decompilation of the data or functions of this application. The User is prohibited from using programs with viruses or other malware in the Software, whether knowingly or unknowingly.
Our products or services may contain links to third party websites or resources. You acknowledge and agree that AI Test Prep is not responsible or liable for (i) the availability or accuracy of such sites or resources; or (ii) the content, products or services on or available from such sites or resources.
Any links to third party websites and resources should not be construed as an endorsement by AI Test Prep of such websites, content or resources, products and services. Your access to such third party websites or resources is at your own risk and responsibility. You should read their terms of use and user agreements for yourself before formally using such sites or resources, and you expressly agree that these Terms and the Privacy Policy do not apply to your use of such sites.
AI Test Prep will endeavor to guarantee the proper operation of our products 24 hours a day, 365 days a year. Our software is generally error-free, but if a User discovers that our products or services are incorrect, defective or unavailable, we will take reasonable steps to fix such errors and restore the User's access to the Services as soon as possible after receiving such feedback, provided that such errors or problems are not due to incorrect use, misuse, or damage to the Subscription Services software, or due to the User improperly using the Subscription Services in conjunction with other software or incompatible equipment, or due to a third party or unauthorized person accessing the Services through the Customer's password or access credentials. incompatible equipment, or due to a third party or unauthorized person accessing the Services through the Customer's password or access credentials.
In addition, in the event of a defect, your warranty claim shall be subject to the relevant legal provisions. Except for the warranties expressly set forth in these Terms, all Services are provided “as is” without warranty of any kind. To the fullest extent permitted by applicable law, AI Test Prep expressly disclaims all express, implied, and statutory warranties, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Services will be error-free.
AI Test Prep's products and services are provided to you on an “as is” and “as available” basis. you access and use our products and any content at your own risk.
AI Test Prep does not represent, authorize or approve any products, services or content offered by any government entity, examination or certification body. No 'scores', 'grades', or 'pass rate predictions' obtained by you in the course of using AI Test Prep's products should be considered a promise or guarantee of any kind. The scores you obtain in using the product are not indicative of the results you can expect on the actual exam.
Without limiting the foregoing, and to the fullest extent permitted by applicable law, AI Test Prep disclaims all warranties and conditions of merchantability, fitness for a particular purpose, or non-infringement, either express or implied. no advice or information, whether oral or written, obtained from AI Test Prep or through the products shall create any warranty not expressly stated herein.
AI Test Prep does not provide any warranty or guarantee that your use of the Products will comply with the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”).
If you are a health care provider, health care plan, insurance company, health care clearinghouse or other “covered entity” that may be considered a “covered entity” under HIPAA or a “covered entity” under HIPAA “Business Associate” entity under HIPAA, then you shall take all necessary steps to comply with HIPAA regulations and shall be responsible for compliance with any applicable HIPAA regulations.
You expressly agree that you will not provide AI Test Prep with any protected health information (as defined by HIPAA) in any form. Accordingly, AI Test Prep is not considered a business associate of you and/or your organization for purposes of compliance with HIPAA regulations.
10.1 Waiver of Consequential Damages. to the fullest extent permitted by applicable law, in no event shall either party be liable for any indirect, special, incidental, consequential, punitive, or exemplary damages, or for any lost profits or lost savings, regardless of the cause thereof, whether arising from breach of contract or breach of warranty, tort, breach of warranty, negligence, or otherwise, and regardless of whether such party has been advised of the likelihood.
10.2 Limitation of Liability. In addition to each party's indemnification obligations under this Agreement, to the maximum extent permitted by applicable law, each party's aggregate liability arising out of this Agreement shall be limited to the aggregate amount of fees paid or payable to AI Test Prep under the Applicable Order during the twelve (12) months prior to the date on which the event giving rise to the applicable Service Liability first occurred.
Contracts concluded under these terms and conditions shall be governed by Chinese law. If any of these terms are invalid, this shall not affect the validity of the remaining terms. If technical, economic or legal reasons so require, AI Test Prep may modify and update these terms and conditions with effect for the future.
